Terms of Service

These terms govern use of Tuma to send messages to your customers over WhatsApp through the API and dashboard.

Account responsibilities

Provide accurate information, protect your credentials and API keys, connect only WhatsApp numbers you are authorized to use, and ensure your messages and recipient lists comply with applicable law, WhatsApp’s terms, and anti-spam rules.

Acceptable use and consent

You must have a lawful basis and, where required, recipient consent before messaging people. No spam, fraud, unlawful content, harassment, unauthorized access, or activity that harms recipients, WhatsApp, M-Pesa, the service, or other users. Sending is provided as available and may be rate-limited or suspended to protect the platform and its users.

Payments and plans

Paid plans run for the period shown at checkout and renew by M-Pesa authorization. A grace period may apply after expiry before the account returns to Starter limits.

Availability and suspension

We work to keep the service available but do not promise uninterrupted operation. We may suspend an account to protect users, comply with legal obligations, respond to abuse, or address material non-payment.

Liability

To the extent permitted by law, the service is provided as available and liability is limited to fees paid for the affected service period. We are not responsible for delivery outcomes on WhatsApp’s network or for number restrictions arising from how you use the service. These terms do not exclude rights that cannot legally be excluded.

Changes and termination

You may stop using the service at any time and downgrade from the billing page. We may update these terms with notice appropriate to the change. Continued use after an update constitutes acceptance.
